Beacon Hill Terms & Conditions

Behind every term is a story

1. Introduction

The Beacon Hill Terms and Conditions (“Terms”) shall apply when Guest (“you” and “your”) reserve a room or guest house (an “accommodation”) at Beacon Hill Bed & Breakfast or Beacon Hill Guest House DBAs of Beacon Hill Holdings, Series LLC, a Texas limited liability company (“Beacon Hill,” “we,” “us,” and “our”).

We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation. The terms and conditions applying to your reservation will be those in place on the date that you make your reservation.

Effective Date: September 3, 2019. The following supersedes all prior Beacon Hill Terms & Conditions. By participating or continuing to participate after the effective date, you agree to the following:

2. Definitions

2.1 “Accommodation Rate” means the rate selected by Guest for the accommodation
2.2 “Extra Services” means the packages or services not included in the Accommodation Rate
2.3 “Partners” mean third party companies that assist in Beacon Hill operations
2.4 “Reservation Period” means period of time between Guest check-in and check-out

3. Reservations

3.1 Minimum Age
Must be a minimum of 21 to check-in. Guests under 21 must be accompanied by a parent/guardian 21 years or older. Valid identification is required at check in.

3.2 Minimum Stay
A minimum stay may be required for reservations during holidays and special events; please call us at 281-326-7643 if you have questions about specific dates.

3.3 Check-in and Check-out
Check-in time is from 3:00 p.m. to 6:00 p.m. Please contact us to coordinate check-in, so we can arrange someone to meet you. Check-out time is 11:00 a.m.

3.4 Early Check-in, Late Check-out
There is a $25 per hour fee for early check in or late check out. Just give us a call and ask if you can add it to your reservation. We try to always accommodate you, but sometimes early check in or late check out might not be available.

3.5 Children
Well-mannered children age 12 and over are welcome at our Guest Houses. No Children under 18 are allowed at the Bed & Breakfast.

3.6 No Pets
For the welfare of our guests with allergies, Beacon Hill is not pet friendly.

3.7 No Smoking
For the safety and comfort of all of our guests, Beacon Hill does not allow smoking at any of its locations. Smoking includes, cigarette, cigar, incense and candle burning. Courteous smoking is permitted outside only, at a minimum of 25 feet away from entry doors. Guests smoking in the house will be charged a minimum fee of $400 to return any room(s) to a no-smoking status.

3.8 Events
Guests may have up to four visitors per rented accommodation. Five or more visitors will constitute an event and a fee will be applied of no less than $3,000.00 plus $25 per additional visitor over five.

4. Payment Policy

4.1 Payment Authorization
Guest authorizes Beacon Hill and its Partners to charge Guest credit card or bank account at the selected Accommodation Rate for the Reservation Period as well as for any extension of the Reservation Period or for Extra Services rendered. Authorization is for initial payment prior to Reservation Period to secure reservation and payment after Reservation Period for add-ons and Extra Services not addressed in initial payment. Authorization continues for 10 days after end of the Reservation Period.

4.2 Payment Methods and Procedures
We accept all major credit cards Visa, MasterCard, Diners Club, Discover, and American Express checks and cash for final payments. Personal checks are not accepted. By providing your credit card you authorize Beacon Hill to charge your credit card account for all accommodation charges, including any incidentals, packages, and all merchandise purchased, damaged or destroyed during your stay.

4.3 Double Occupancy
All Accommodation Rates are based on double occupancy. Our two Guest Houses can accommodate up to 2 additional persons at a cost of $15.00 per person per night.

4.4 Applicable Taxes
A 17% Hotel Occupancy Tax will be added to all accommodation rates. This represents 6% to the State of Texas, 4% to Harris County, and 7% to the City of Seabrook

5. Cancellation Policy

5.1 Standard Rate Cancellation by Customer
Full refund for cancellations made within 48 hours of booking, if the check-in date is at least 14 days away. 50% refund for cancellations made at least 7 days before check-in. No refunds for cancellations made within 7 days of check-in. Refunds for cancellations are less $35 plus processing fees. There are no refunds for holidays, holiday weeks, special events, late arrival or early departure. Discounted rates and Special rates are non-refundable, if you choose to cancel this reservation, you will not be refunded any of the payment.

5.2 Non-Refundable Rate Cancellation by Customer
If you do choose to change or cancel this reservation you will not be refunded any of the payment.

5.3 Cancellation by Beacon Hill
We may cancel your reservation if an event outside of our control (including hurricanes, flooding, mandatory evacuation, industrial action, explosion, fire, technology failure or failure of power and/or water supplies) means that we are unable to make your accommodation available to you. In this case we will contact you to let you know as soon as possible and if you have already paid for your accommodation, we will refund your payment to you. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control.

We may also cancel your reservation at any time with immediate effect by giving you written notice (which includes email) for events such as Guest’s failure to make payment for accommodation; or breach of Terms & Conditions in any other material way. If we cancel your reservation where you are at fault, we reserve our legal rights in respect of your breach of contract.

6. Limited Liability

6.1 Liability Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEACON HILL HOLDINGS SERIES LLC, A TEXAS LIMITED LIABILITY COMPANY DOING BUSINESS AS BEACON HILL BED & BREAKFAST, AND BEACON HILL GUEST HOUSES WILL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR FOR ANY COST TO SUBSTITUTE PRODUCTS OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT YOU HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BEACON HILL’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR ORGANIZATION’S USE OF THE TEAMS PRODUCT, EXCEED $5,000 U.S. DOLLARS. THIS SECTION WILL SURVIVE THE TERMINATION OF THESE TERMS.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

6.2 Links to Third-Party Sites
This Website may contain hyperlinks to websites operated by parties other than Beacon Hill. Such hyperlinks are provided for your reference only. We do not control such websites and are not responsible for their contents or the privacy or other practices of such websites. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from this Website or other websites) is free of such items as viruses, worms, Trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.

7. General Terms

7.1 Severability
If any provisions of these Terms and Conditions is illegal or unenforceable, that provision is severed from the Terms and Conditions, and the other provisions remain in effect only if the essential business and legal provisions are legal and enforceable.

7.2 Governing Law
The laws of Texas, without regard to its conflict of laws principles, govern all mattes arising under or relating to this Terms and Conditions, including torts.
